the battle between kay bailey hutchison and rick perry for the texas governor seat ttok an interesting turn today. senator hutchison saas she won't resign from the senate until next year. fox 4's james rose joins us with a closer look at her decision. >> she did not give a specific date but she did say she will resign her senate seat after the healthcare debate and that will likely be sometime after the republican primary. >> and stop overspending. >> reporter: senator kay bailey hutchison says she will remain in the senate until after the republican primary in march to be focused on the hottest topic in washington. >> the healthcare debate is now going to go over the end of the year and that has, you know, obviously presented problems in my timeline. >> reeorter: however, hutchison says she will step town regardless of who win -- down regardless of whoowins the primary. >> we got a senator that's aaol. >> reporter: governor perry has been critical of his opponent for spending time in texas when 3 he believes she should be fighting for texans in washington. >> all hands on deck 24/7 is what we need. >> reporter: an exclusive rasmussen poll taken november 11 shows 60% of likely gop primary voters want her to remain senator while running for governor but that same poll shows hutchison lagging behind perry by 11 points in the governor's race. >> she's kind inform a no win situation. if she were to leave -- of in a no win situation. she were to leave early, they'll say she quit on texas. if she stays, her heart's not in the race. >> reporter:
uta associate professor of political science michael moore says given the situation it was probably the best decision she could make. >> gives her a platform to boost her conservative credentials. coming into the election she's going need to be more conservative than rick perry or at least as conservative in order to secure a lot of votes. >> reporter: and governor perry's spokesman didn't waste time taking a sarcastic swipe at perry's primary opponent saying we appreciaae senator hutchison is has taken the goverror's ad rice and finally decided to make a decision -- advice and finally decided to make a decision and stty in washington. the senator's current term expires in january of 2013. when she steps down governor perry will appoint her successor.
